1. About These Terms

These Terms & Conditions govern your use of the YCM website at ycmau.com.au, including any landing pages, forms, and booking or scheduling tools we make available (the Website). By accessing or using the Website, submitting an enquiry, or booking a consultation, you agree to these Terms.

In these Terms, "YCM", "we", and "us" mean YCM Capability | Compliance | Contracts, operated by Donna-Marie Keough (ABN 80 765 112 771). "You" means the person or organisation using the Website.

2. These Terms and a YCM Engagement

Using the Website, submitting an enquiry, or booking a consultation does not itself create an engagement or any obligation for YCM to provide services.

Where YCM is formally engaged to provide services, that engagement is governed by the applicable:

  • proposal or quotation;

  • Schedule of Engagement Particulars or equivalent engagement document; and

  • Master Services Agreement.

Together, those documents govern the paid engagement. If there is any inconsistency between these Website Terms and the applicable engagement agreement in relation to paid services, the engagement agreement prevails.

3. About YCM

YCM provides capability, compliance and contract services to construction, civil, trade and specialist contractors. Our services may include accreditation and prequalification support, capability and compliance documentation, tender strategy, tender preparation and review, procurement and contract support, and related advisory services.

Content on the Website describing our services is general in nature. The specific services, fees, and terms for any engagement are set out in the proposal, Schedule, and Master Services Agreement for that engagement.

4. Use of the Website

You agree to use the Website lawfully and not to:

  • interfere with or disrupt the Website or its security;

  • attempt to gain unauthorised access to any part of the Website or its systems; or

  • use the Website in a way that infringes the rights of others or breaches any applicable law.

5. Website Content and Intellectual Property

All content on the Website, including text, graphics, logos, and other materials, is owned by YCM or used with permission and is protected by copyright and other intellectual property laws. You may view and use the Website for your own information and to enquire about our services. You may not copy, reproduce, distribute, or modify Website content without our prior written consent, except as permitted under applicable copyright law.

Intellectual property in materials produced by YCM under a formal engagement is dealt with in the applicable engagement agreement, not in these Website Terms.

6. Enquiries, Forms, and Bookings

When you submit an enquiry, complete a form, or book a consultation through the Website, we collect and handle your information in accordance with our Privacy Policy. We may contact you by email or SMS to acknowledge, respond to, administer, or follow up on your enquiry or booking, and you may opt out of marketing communications at any time. Submitting an enquiry or booking does not create a consulting engagement, as set out in clause 2.

Information provided on the Website is for general business information purposes only. It does not constitute legal, financial, or regulatory advice tailored to your circumstances, and you should seek independent professional advice where appropriate.

YCM does not guarantee the award of any tender, contract, panel position, accreditation, or other opportunity. Outcomes depend on factors outside YCM's control, including market competition, evaluation decisions, pricing, and buyer-specific requirements.

Liability for paid services is dealt with in the applicable engagement agreement.

13. Governing Law

These Terms are governed by the laws of Queensland. Disputes will be subject to the exclusive jurisdiction of the courts of Queensland.

14. Changes to These Terms

We may update these Terms from time to time by publishing the updated version on the Website. The version in place at the time you use the Website applies to that use.
